These Terms and Conditions specify the regulations concerning shopping store: annablum.biz

 

§1 Definitions

Terms and Conditions – this document specifying the regulations for using the online store

Seller – Anna Żarska-Blumicz, Tax Identification Number 9562065713 National Business Registry Number 300888387 with its registered office at Dąbrowskiego 30a/8 Street, 60-841 Poznań

Online Store– an online store operating at the address annablum.biz

Price –gross value of the product, excluding delivery costs

Customer, Buyer –a person making a purchase in an online store

Customer Account an account in online store, a collection of information and resources visible to the customer after registration and then after logging in.

User– a natural person, who makes purchases in the online store, but has not been registered

Registered User– a user who has a customer account in an online store

Working Day a day from Monday to Friday, except for public holidays, as well as days indicated in the online store or Social Media channels such as Facebook or Instagram as holiday days

Force Majeure– an accidental event or event related to the natural elements, which is beyond the Seller’s control (e.g. a fire, flood, earthquake, explosion, power failure, as well as riots, acts of terrorism, war, actions and/or omissions of telecommunication network operators, as well as other random events such as an accident or illness).

 

§2 General provisions

  1. The Terms and Conditions are available free of charge on the Seller’s website. The Buyer is obliged to read them before making purchases in the online store. In addition, at the request of the Customer it is possible to make the document available in another form, which will enable to obtain and consolidate the content of these Terms and Conditions.

  2. Each product page contains information on the general product description, the price of product, the date of order execution by the Seller, as well as the time and method of delivery. The agreement is concluded only when the Seller receives the Buyer’s order for processing.

 

§3 Products

  1. The online store offers women’s clothing and home textiles. All products are brand new and free from any physical or legal defects. They are sewn and designed in Poland.

  2. The Seller has the possibility to introduce discount codes and promotions for particular goods or sets, and may also introduce changes in the prices of offered products.

  3. Subscribers to the Newsletter will be informed about discounts, sales and promotions.

  4. In the online store, on the website of each product, you will find information about the product. This includes information regarding the product, its cut, fabric composition, size, number of available items, washing and maintenance instructions, as well as payment, replacement and return.

 

§4 Placing an order

  1. An order is placed in the Store by adding a product to your shopping cart. By default, this is a selection of one item of product. The Buyer may increase or decrease the amount of products added to the cart. After selecting the quantity, you need to update the card by clicking on the “order” button.

  2. After confirming the shopping cart, the Buyer goes to a page where they can log in if they have an account or place an order without logging in.

  3. On the card, the Buyer enters his contact and shipping details, as well as the payment method. It is also possible to add a discount voucher which, if entered correctly, reduces the amount to be paid.

  4. The Buyer is also asked to accept the Terms and Conditions. Lack of acceptance of these Terms and Conditions makes it impossible to place an order. The conclusion of the agreement is confirmed by the Buyer by clicking “Order and pay” button.

  5. The Seller sends an e-mail message informing about the order placed by the Buyer. It contains a summary of the order, as well as a separate e-mail informing about the acceptance of the order for processing. It contains information about the shipment of the ordered product and the planned delivery date. A sales agreement is concluded when the store receives an e-mail with information about accepting the order for processing. Information about the acceptance of order for processing should be received on the Customer’s account within 3 working days. Otherwise, the Customer ceases to be bound by the agreement.

  6. In special cases, it is possible to make a purchase by e-mail contact. However, in such a case, before placing an order, the Customer receives via e-mail the Terms and Conditions and is asked to accept them.

 

§5 Price and method of payment

  1. Prices of all products in the online store are given in Polish zlotys (PLN), American dollars (USD), and Euros (EUR) and do not include delivery costs. The cost of delivery is shown on the Order Card. The Customer can choose the payment method. The Seller is not a VAT payer.

  2. The Customer can choose one of the following payments:

a)      payment via PayPal

b)      payment via Przelewy 24 (only in Poland)

c)      cash on delivery of the personal product

 

§6 Shipment and delivery time

  1. The goods are sent to the Customer via the Polish Post Office or courier company. The Buyer is informed about the shipment number and can track its expected date of delivery (in exceptional cases may be collected in person).

  2. The order is sent after the payment is credited. Earlier, the External Payment Channel sends an e-mail to the Buyer with information about making the above payment. If you order more than one product, the delivery time is the longest for one of the products.

  3. The ordered product is shipped immediately, depending on the type of product. Within 1-5 working days after the payment is credited for products in finished sizes; within 4-8 working days for products on individual orders.

 

§7 Availability of goods

  1. Goods for which “add to cart” option is active are usually available within 1-5 working days – this applies to finished product dimensions. This does not apply to “custom-made products” – to individual customer dimensions. Products for individual customer dimensions are available within 4-8 working days.

  2. If it is not possible to execute the entire order (all goods within one order), the Customer is informed about this situation immediately and can choose the appropriate option:

-        partial execution of the order,

-        extending the waiting time,

-        cancellation of the entire order.

  1. The Seller in special cases (force majeure, lack of goods) reserves the right not to accept the order. In such a case, the Seller shall inform the Buyer accordingly. The money paid in is then refunded.

 

§8 Complaints

  1. We make every effort to ensure that our products are of the highest quality. However, if it turns out that there are any defects, the Customer may lodge a complaint regarding the product.

  2. Complaints should be submitted to the correspondence address with a note “Complaint”. In the notification should be given the order number, and a description of non-compliance or irregularities, as well as possible indication of the complaint settlement (replacement of goods, return of funds).

  3. Settlement of the complaint will take place within 14 days from receiving the complaint. Within this period, a reply will be provided concerning the acceptance or rejection of the complaint.

  4. If the complaint is accepted, the Seller shall bear the costs of transport of the product complained in the amount of the cheapest means of transport from the offer. The Seller will return the funds to the Customer’s account,

  5. We offer the possibility of resolving disputes electronically via the European Union’s online dispute resolution (ODR) platform. Link to ODR platform http://ec.europa.eu/consumers/odr/. The ODR platform will enable the trader to resolve a dispute with a Consumer over the Internet even if the Consumer is resident in another Member State and speaks a different language.

 

§9 Right of withdrawal

  1. The Customer may withdraw from the agreement within 14 days without giving any reason.

  2. The withdrawal period expires after 14 days from the date of receipt of the goods. In order to exercise the right to withdraw from the agreement, the Customer should inform the Seller about the withdrawal from the agreement in a form of unambiguous statement (for example, a letter sent via e-mail to: info@annablum.biz). The Customer may use the standard withdrawal form (this is not mandatory).

  3. The returned product should be in a complete and new condition (unused) – with labels, buttons, all decorative elements. The Customer should return the goods in the same qualitative and quantitative composition as received. If documents, instructions or items/accessories are enclosed with the product, they must be returned. The invoice, bill or receipt must also be returned. The return should be sent to the Seller’s address indicated in the Terms and Conditions as a correspondence address.

  4. If the Customer withdraws from the agreement, the Seller shall return all payments received to the Customer. The Customer is obliged to cover the costs of packaging and sending the goods, as well as shipping, if this is not the cheapest shipment from the offer, which was sold. The refund will be made using the same payment methods as those used by the Buyer in the original transaction.

  5. Exceptionally, the Customer may not withdraw from the agreement if the subject of service is an item manufactured to the Customer’s specifications or an item personalized and identified, custom-made to the Customer’s preferences.

 

§10 Protection of personal data

  1. Data entrusted by Users, such as: name, surname, address of residence, shipping address, telephone number, e-mail address, order information, will be used for processing orders. Providing this data is voluntary, but necessary to carry out the order by the store. In case of Users who have registered their Customer Account, the data will be additionally processed in order to establish and maintain the Customer Account. The data of Users who have given their consent will be processed in order to provide them electronically with commercial information concerning the Store’s offer.

  2. Users have access to the content of their data, can change and correct them, and demand their removal. Users who have registered their Customer Account have direct access to their data through the administrative panel of the Customer.

  3. Personal data are managed in accordance with Article 13 (1) and (22016/67995/46/WERODO).

  4. The manner of data processing in the Store is determined by the Privacy Policy.

 

§11 Intellectual property

  1. All copyrights to the photos of products are the Seller’s property.

  2. It is forbidden to distribute any elements of the Store (descriptions, photos of products, logo of the Store) without the Seller’s consent.

  3. It is forbidden to use the Store in a way that violates the Seller’s or other entities’ rights.

 

§12 Final provisions

  1. The Customer is obliged to use own personal data.

  2. It is forbidden to provide illegal content by the Customer.

  3. These Terms and Conditions are available on the website annablum.biz. Each User has the possibility to access the Terms and Conditions, copy and print them.

  4. The Seller may introduce changes in the Terms and Conditions, as well as changes in product prices. The Buyer is bound by the price shown on the order card in the Store.

  5. In matters not regulated in these Terms and Conditions, the relevant provisions of Polish law shall apply.

  6. Attachments to the Terms and Conditions constitute an integral part of the Agreement.
